France: Decree on application of data protection act comes into effect

Decree No. 2019-536 of 29 May 2019 ('the Decree') Enacted For the Application of Act No. 78-17 of 6 January 1978 on Data Processing, Files and Individual Liberties ('the Act') entered, on 1 June 2019, into effect. In particular, the Decree clarifies procedural rules of the French data protection authority, including its control and sanctions, and further specifies data subject rights and repeals Decree No. 2005-1309 of 20 October 2005 Enacted For the Application of the Act Amended By Act No. 2004-801 of 6 August 2004. In addition, the Decree seeks to bring the Act (as amended) in line with the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR') and the Data Protection Directive with Respect to Law Enforcement (Directive (EU) 2016/680).

Furthermore, Ordinance No. 2018-1125 of 12 December 2018 Amending the Act and Various Provisions Concerning the Protection of Personal Data entered, on 1 June 2019, into effect, further to the enactment of the Decree.
